The end of a relationship usually brings with it a whole host of questions that need to be answered.
- Who is going to pay the mortgage or rent?
- Where are we each going to live?
- Who will our children live with?
- Who gets to stay in the house?
- Will we need to sell the house?
- How will I have enough money to support myself and/or my children?
- Do I need a divorce?
- Do I have to share my superannuation?
- How much is this going to cost?
- How long will this all take?
This list is only the tip of the iceberg.
While there is a common thread of concerns and questions asked by anyone who has just separated or is thinking about separation, the answers or solution are usually very different because every relationship and family is unique.
One of the most important things you need to do if you have separated or are thinking about separation is to become informed of the best steps to take in YOUR situation by obtaining family law advice. Friends and family can provide amazing support but what happened in their case probably won’t apply to you. Every matter is different.
Decisions and agreements can be made in relation to property and assets and future parenting arrangements straight after you have separated. In fact the best time to work through these issues is often as soon as possible after a separation. You do not need to wait until you are divorced as you are not eligible to get divorce until you have been separated for at least two years.
